Terms of Service

These terms govern your use of the Clicky smart TV remote application.

1. Acceptance

By accessing zesbe.com or downloading, purchasing, or using Clicky (the “Services”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Services. You must be legally capable of entering this agreement in your jurisdiction.

2. What Clicky provides

Clicky is an iOS utility that discovers and controls compatible televisions and streaming devices over a local network. Features may include pairing, directional navigation, touchpad gestures, playback, volume, channels, power or standby commands, input selection, text entry, voice-to-text, app launching, saved devices, and reconnection. The controls available depend on the connected platform’s verified capabilities.

Clicky is an independent product. Zesbe is not affiliated with or endorsed by Apple, Amazon, Google, Hisense, LG, Philips, Roku, Samsung, Sony, Vizio, television manufacturers, or streaming services unless expressly stated. Product and company names belong to their respective owners.

3. Compatibility and network requirements

You are responsible for a compatible iPhone, iOS version, television, home network, TV settings, and required permissions. Your iPhone and TV generally must be connected to the same reachable local network. Guest networks, client isolation, VPNs, firewalls, deep-sleep modes, firmware changes, manufacturer restrictions, or disabled remote-control settings may prevent discovery or control.

Compatibility varies by model, model year, region, firmware, platform, and TV configuration. Discovery does not guarantee full control. A command reported as sent may still be ignored by a TV. Power-on often depends on network standby or Wake-on-LAN and may not work after a hard shutdown. Third-party platform updates can change or remove functionality.

4. Permissions and pairing

Clicky requires Local Network permission to find and communicate with TVs. Some features may request microphone or speech-recognition permission. Many platforms require approval or a code shown on the TV. You must only pair with and control devices you own or are authorized to use.

5. Ads, Clicky Premium, and purchases

The free version may display advertisements through Google Mobile Ads. The current release uses banner ads; future releases may add other clearly identified ad formats. Clicky Premium removes ads while a valid entitlement is active.

Available products may include a monthly auto-renewable subscription and a one-time lifetime non-consumable purchase. Current prices and localized terms are displayed by Apple before purchase and may change for future purchases. “Lifetime” means access for the supported life of the Clicky product and associated entitlement; it does not guarantee perpetual availability of third-party TV protocols, platforms, or App Store services.

Monthly subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Apple charges your Apple ID and manages renewal, cancellation, billing, refunds, and family-sharing eligibility. You can manage subscriptions in your Apple ID settings and restore eligible purchases in Clicky. Except where required by law or Apple policy, purchases are subject to Apple’s refund rules.

6. Acceptable use

You agree not to:

  • control a device without the owner’s permission;
  • use the Services unlawfully, abusively, or to interfere with another person’s network or devices;
  • attempt to bypass pairing, authentication, security, rate limits, or access controls;
  • reverse engineer, copy, resell, or redistribute the Services except where law expressly permits;
  • introduce malware, automated attacks, or excessive traffic; or
  • misrepresent your identity or use the contact form for spam.

7. Ownership and licence

Zesbe and its licensors retain all rights in the Services, including software, design, text, graphics, trademarks, and branding. Subject to these terms, Zesbe grants you a personal, limited, non-exclusive, non-transferable, revocable licence to use Clicky on Apple devices you own or control as permitted by the App Store rules.

Feedback may be used by Zesbe without obligation, provided we do not publicly identify you without permission.

8. Third-party services

The Services rely on third parties including Apple, Google Mobile Ads, RevenueCat, television platforms, network equipment, and hosting providers. Third-party services are governed by their own terms and may change or become unavailable. Zesbe is not responsible for third-party content, policies, outages, or changes.

9. Disclaimers

To the maximum extent permitted by law, the Services are provided “as is” and “as available.” Zesbe disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation. We do not warrant that Clicky will discover or control every TV, that every command will be accepted, or that a feature will remain compatible after third-party updates.

Nothing in these terms excludes warranties or consumer rights that cannot legally be excluded.

10. Limitation of liability

To the maximum extent permitted by law, Zesbe will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, revenue, profits, goodwill, or use; network or device problems; or third-party conduct arising from the Services. Where liability cannot be excluded, Zesbe’s aggregate liability will not exceed the greater of the amount you paid for Clicky during the 12 months before the claim or CAD $50.

11. Indemnity

To the extent permitted by law, you agree to indemnify Zesbe from claims and reasonable costs resulting from your unlawful use of the Services, violation of these terms, or control of a device without authorization.

12. Suspension and termination

You may stop using the Services at any time. Zesbe may suspend or terminate access when reasonably necessary to protect the Services, users, networks, legal compliance, or third-party systems. Sections that by their nature should survive termination will continue to apply.

13. Changes

We may update the Services and these terms. The updated date will appear above. Continued use after revised terms take effect means you accept them, except where additional notice or consent is required by law.

14. Governing law

These terms are governed by the laws of British Columbia and the applicable federal laws of Canada, without regard to conflict-of-law rules. Courts located in British Columbia will have jurisdiction, unless mandatory consumer law provides otherwise.

15. Additional Terms for Apple App Store Users

This section applies only if you obtained Clicky through Apple’s App Store, and supplements the sections above.

Acknowledgement: This agreement is between you and Zesbe only, not with Apple, and Apple is not responsible for the Services or their content.

License Scope: Zesbe grants you a non-transferable licence to use Clicky on Apple-branded products that you own or control, as permitted by the App Store’s Usage Rules.

Maintenance and Support: Zesbe, not Apple, is solely responsible for providing any maintenance and support for Clicky, to the extent required under applicable law.

Warranty: In the event of any failure of Clicky to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for Clicky to you, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to Clicky, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to a warranty are Zesbe’s sole responsibility.

Product Claims: Zesbe, not Apple, is responsible for addressing any claims from you or any third party relating to Clicky, including but not limited to: (i) product liability claims; (ii) any claim that Clicky fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

Intellectual Property Rights: In the event of any third-party claim that Clicky or your possession and use of Clicky infringes that third party’s intellectual property rights, Zesbe, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

Third-Party Terms of Agreement: You must comply with applicable third-party terms of agreement when using Clicky (for example, your wireless data service agreement).

Legal Compliance: You represent and warrant that you are not located in a country subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-Party Beneficiary: You and Zesbe acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
